Việc chuyển quyền sử dụng đất đai c

Việc chuyển quyền sử dụng đất đai chỉ thực hiện trong các trường hợp sau đây:

1- Khi hộ nông dân vào hoặc ra hợp tác xã, tập đoàn sản xuất nông nghiệp, lâm nghiệp;

2- Khi hợp tác xã, tập đoàn sản xuất nông nghiệp và cá nhân thoả thuận đổi đất cho nhau để tổ chức lại sản xuất;

3- Khi người được giao đất chuyển đi nơi khác hoặc đã chết mà thành viên trong hộ của người đó vẫn còn tiếp tục sử dụng đất đó.

Việc chuyển quyền sử dụng đất đai nói trong Điều này, nếu ở nông thôn thì do Uỷ ban nhân dân xã quyết định, nếu ở thành thị thì do Uỷ ban nhân dân huyện, quận, thị xã, thành phố trực thuộc tỉnh quyết định.
