Đối với việc sử dụng Khu Đất theo đúng quy định của pháp luật và Quy Hoạch 1/500, không có một bên thứ ba nào có bất kỳ quyền phi tài sản nào đối với Khu Đất và các tài sản trên đất, ngoại trừ các khu vực được quy định rõ công năng là cho mục đích sử dụng công cộng và có thể được tiếp cận bởi bất kỳ ai được quy định tại Quyết định số 6331/QĐ-UBND của Ủy ban Nhân dân thành phố Hồ Chí Minh ngày 30/11/2015 về duyệt đồ án quy hoạch chi tiết tỷ lệ 1/500 Tiểu khu Cảng Quận 4, Phường 12, 13 và 18, Quận 4, thành phố Hồ Chí Minh. Để tránh hiểu lầm, “công năng là cho mục đích sử dụng công cộng và có thể được tiếp cận bởi bất kỳ ai” được hiểu là công năng sử dụng và quyền tiếp cận không được trao riêng cho bất kỳ ai (bao gồm cả chủ đầu tư Dự Án, những người mua, thuê tài sản của Dự Án, và bất kỳ bên thứ ba nào khác). Quyền phi tài sản được đề cập trong khoản này bao gồm, nhưng không giới hạn trong phạm vi các quyền sau: quyền được xây dựng tượng đài, bia kỷ niệm, nhà lưu niệm, phù điêu (ngoại trừ khu vực được quy định rõ cho việc này trong quy hoạch 1/500 được phê duyệt của Dự Án), quyền tiếp cận, sử dụng đối với các công trình ngầm dưới Khu Đất, quyền neo đậu tàu, thuyền và các phương tiện vận tải đường thuỷ ngoài ranh nhưng trên khu vực mặt nước liền kề Dự Án.
