a. Người lao động có thời gian làm việc trong năm đủ 12 tháng thì được nghỉ phép năm hưởng nguyên lương theo quy định sau đây:
- 12 ngày phép, đối với người làm việc trong điều kiện bình thường.
- 14 ngày phép, đối với người làm việc trong điều kiện năng nhọc, độc hại, nguy hiểm hoặc người làm việc ở những nơi có có điều kiện sinh sống khắc nghiệt theo danh mục do Bộ Lao động, Thương binh và Xã hội chủ trì phối hợp với Bộ Y tế ban hành.
- 16 ngày làm việc đối với người làm công việc đặc biệt nặng nhọc, độc hại, nguy hiểm hoặc người làm việc ở những nơi có điều kiện sinh sống đặc biệt khắc nghiệt theo danh mục do Bộ Lao động, Thương binh và Xã hội chủ trì phối hợp với Bộ Y tế ban hành.
b. Người lao động có thời gian làm việc dưới 12 tháng thì số ngày phép năm được tính theo tỉ lệ tương ứng với số tháng làm việc.
c. Số ngày phép năm được tăng theo thâm niên làm việc, cứ 03 năm làm việc tại Công ty, Người lao động được nghỉ thêm 01 ngày phép.
d. Công ty có quyền quy định lịch nghỉ hằng năm sau khi tham khảo ý kiến của người lao động và phải thông báo trước cho người lao động. Số ngày phép năm được giải quyết đến hết Quý I của năm sau.
Đối với người lao động làm việc theo ca trên các công trình ngầm, công trình biển thì trong trường hợp không thể bố trí cho người lao động nghỉ phép hàng năm thì có thể bố trí cho người lao động nghỉ phép vào thời gian phù hợp.
e. Người lao động có thể thỏa thuận với Công ty để nghỉ phép hàng năm thành một lần hay nhiều lần trong năm hoặc nghỉ gộp tối đa 03 năm một lần tùy theo hoàn cảnh của người lao động và tình hình hoạt động sản xuất kinh doanh của Công ty.
f. Khi nghỉ hằng năm, nếu người lao động đi bằng các phương tiện đường sắt, đường thủy, đường bộ mà số ngày đi đường cả đi và về trên 02 ngày thì từ ngày thứ 03 trở đi được tính thêm thời gian đi đường ngoài ngày nghỉ hàng năm và chỉ được tính cho 01 lần nghỉ trong năm.
