Theo Điều 7 Luật Đầu tư, Nhà nước bảo hộ quyền sở hữu trí tuệ trong hoạt động đầu tư; bảo đảm lợi ích hợp pháp của nhà đầu tư trong việc chuyển giao công nghệ tại Việt Nam theo quy định của pháp luật về sở hữu trí tuệ và các quy định khác của pháp luật có liên quan. Cùng với các quy định trong Luật đầu tư, quyền sở hữu trí tuệ của nhà đầu tư còn được bảo hộ theo các quy định của Bộ luật Dân sự năm 2005, Luật Sở hữu trí tuệ năm 2005 và các văn bản hướng dẫn thi hành. Theo các quy định này, các chủ thể quyền sở hữu trí tuệ có thể được bảo vệ bằng các biện pháp dân sự, hành chính hoặc hình sự.

Under article 7 the Investment Law, the State intellectual property right protection in investment activities; ensure the legal interests of investors in the technology transfer in Vietnam under the provisions of the law on intellectual property, and the other provisions of the relevant legislation. Along with the provisions of the investment law, the intellectual property rights of investors also are protected by the provisions of the civil code in 2005, the 2005 intellectual property Law and other documents guiding the implementation. According to these regulations, the owner of intellectual property rights can be protected by the civil, administrative or criminal.

According to Article 7 of the Law on Investment and State protection of intellectual property rights in investment activities; ensure that the legitimate interests of investors in the technology transfer in Vietnam under the provisions of the law on intellectual property and other provisions of the relevant law. Along with the provisions of the Investment Law, the intellectual property rights of investors are also protected under the provisions of the 2005 Civil Code, the Law on Intellectual Property in 2005 and the guiding documents . Under these regulations, the holder of intellectual property rights can be protected by civil remedies, administrative or criminal.
