Trong đời sống xã hội, pháp luật có vai trò đặc biệt quan trọng. Nó là phương tiện không thể thiếu bảo đảm cho sự tồn tại, vận hành bình thường của xã hội nói chung và của nền đạo đức nói riêng. Trong công cuộc đổi mới đất nước hiện nay, việc tăng cường vai trò của pháp luật được đặt ra như một tất yếu khách quan. Điều đó không chỉ nhằm mục đích xây dựng một xã hội có trật tự, kỷ cương, văn minh, mà còn hướng đến bảo vệ và phát triển các giá trị chân chính, trong đó có ý thức đạo đức.
Trong hệ thống văn bản pháp luật của nước ta, kể cả Hiến pháp, các bộ luật và văn bản dưới luật thường có nhiều quy phạm pháp luật ghi nhận những giá trị, những chuẩn mực đạo đức. Ngoài ra, các bộ luật, như Bộ luật hình sự, Bộ luật dân sự, Luật hôn nhân và gia đình, Luật bảo vệ và chăm sóc trẻ em… đều được xây dựng trên cơ sở những chuẩn mực đạo đức truyền thống tốt đẹp của dân tộc. Vì vậy, có thể nhấn mạnh rằng, pháp luật vừa là công cụ hữu hiệu trong việc bảo tồn những giá trị truyền thông, vừa góp phần bồi đắp nên những giá trị mới trong đó có ý thức đạo đức. Việt Nam vốn là một nước kém phát triển, lại đang chuyển sang xây dựng nền kinh tế thị trường. Trong điều kiện như vậy, sự ít hiểu biết về pháp luật của một bộ phận nhân dân cùng với những bất cập của hệ thống pháp luật đã dẫn đến tình trạng vi phạm kỷ cương xã hội, coi thường pháp luật Nạn tham nhũng và các hành vi làm ăn bất lương, vượt ra ngoài khuôn khổ của pháp luật đang ngày càng gia tăng.
