Hiện nay, Việt Nam đang từng ngày khẳng định mình trên sân chơi Quốc tế, nền kinh tế thị trường đã được định hình và bắt đầu phát triển mạnh, cũng từ đây những quy luật của nó cũng được thể hiện rõ nét. Cho thuê đất là một hoạt động tất yếu của nền kinh tế nhằm đảm bảo nhu cầu đầu tư, sử dụng đất của những đối tượng có nhu cầu. Đây là một hoạt động liên quan đến nhiều mối quan hệ, ảnh hưởng đến sự phát triển kinh tế - xã hội. Cũng như nhiều nước trên thế giới, Việt Nam luôn có sự quan tâm, điều chỉnh và giải quyết kịp thời các yêu cầu đặt ra trong hoạt động cho thuê đất. Với việc ban hành các quy định điều chỉnh hoạt động cho thuê đất ngày một hoàn thiện trong hệ thống pháp luật đất đai đã tạo nên một hành lang pháp lý điều chỉnh hiệu quả hoạt động cho thuê đất hiện nay.
Trong phạm vi luận văn thạc sĩ của mình, tác giả đã nỗ lực nghiên cứu, xây dựng lý luận về vai trò, đặc điểm của đất đai, đặc điểm quan hệ pháp luật đất đai có liên quan mật thiết đến hoạt động cho thuê đất, lý luận về pháp luật cho thuê đất, đánh giá chung về tình hình thực hiện pháp luật tại Việt Nam và đi sâu nghiên cứu về tình hình thực hiện pháp luật cho thuê đất tại địa bàn tỉnh Thừa Thiên Huế từ đó đưa ra các giải pháp nhằm góp phần hoàn thiện pháp luật về cho thuê đất và giải pháp đảm bảo thực hiện pháp luật cho thuê đất, từ những nghiên cứu đó tôi đưa ra một số kết luận chung sau đây:
Thứ nhất, tác giả luận giải một số vấn đề lí luận về đất đai, quan hệ pháp luật về cho thuê đất như khái niệm, đặc điểm, vai trò; xây dựng, luận giải những vấn đề lý luận về pháp luật cho thuê đất bao gồm: Căn cứ, điều kiện, thẩm quyền, trình tự, thủ tục, đơn giá cho thuê đất. Trên cơ sở phân tích, tìm hiểu các quy định của Luật Đất đai 2013 và các văn bản hướng dẫn thi hành về cho thuê đất, tác giả đã đi sâu phân tích, đối chiếu với các quy định của Luật Đất đai 2003 để làm nổi bật lên các điểm tiến bộ, phù hợp với thực tiễn áp dụng của các quy định mới về cho thuê đất.
Thứ hai, từ những đánh giá chung, khái quát về thực tiễn thực hiện ở nước ta, tác giả đã đi sâu nghiên cứu thực tiễn thực hiện pháp luật tại tỉnh Thừa Thiên Huế. Tìm hiểu khái quát về tình hình kinh tế, chính trị, xã hội của tỉnh có ảnh hưởng đến việc thực hiện pháp luật cho thuê đất, hiện trạng sử dụng đất trên địa bàn tỉnh từ năm 2013 đến 2015 trong đó có hoạt động cho thuê đất, các quy định của UBND tỉnh hướng dẫn thi hành Luật đất đai hiện hành về cho thuê đất. Phân tích, đánh giá các kết quả đạt được trong thực tiễn thực hiện pháp luật về cho thuê đất theo các nội dung: Căn cứ cho thuê đất, điều kiện, trình tự, thủ tục, đơn giá cho thuê đất. Mặt khác, qua thực tiễn nghiên cứu, tác giả đã phân tích, chỉ ra những bất cập, hạn chế và nguyên nhân trong thực tiễn thực hiện pháp luật tại địa bàn tỉnh Thừa Thiên Huế. Nội dung những bất cập bao gồm: Những bất cập từ phía các quy định của pháp luật như thẩm quyền còn chồng chéo, chưa có văn bản hướng dẫn cụ thể dẫn đếm khó thực hiện; bất cập, hạn chế từ phía cơ quan Nhà nước như trình độ, năng lực của đội ngũ cán bộ, công chức, thực hiện chưa đúng các quy định của pháp luật; bất cập từ phía người được cho thuê đất như chậm đưa dự án vào thực hiện, sử dụng sai mục đích sau khi thuê đất.
Thứ ba, trên cơ sở nghiêm cứu các quy định pháp luật về cho thuê đất và thực tiễn thực hiện pháp luật về cho thuê đất tại tỉnh Thừa Thiên Huế hiện nay, tác giả mạnh dạn đưa ra một số định hướng, giải pháp nhằm hoàn thiện quy định của pháp luật về cho thuê đất góp phần hoàn thiện hành lang pháp lý về cho thuê đất. Đồng thời, đưa ra một số giải pháp nhằm nâng cao hiệu quả thực hiện pháp tại tỉnh Thừa Thiên Huế nhằm đảm bảo của các quy định của pháp luật về cho thuê đất được thực hiện một cách hiệu quả.
Thông qua bài luận văn của mình trước hết tác giả mong muốn tìm hiểu các quy định của pháp luật đất đai về cho thuê đất, tìm hiểu về thực trạng pháp luật và thực tiễn thực hiện pháp luật tại địa bàn tỉnh Thừa Thiên Huế để đưa ra một số định hướng, giải pháp nhằm hoàn thiện hành lang pháp lý về cho thuê đất và đưa ra các giải pháp cụ thể nhằm đảm bảo thực hiện pháp luật tại địa bàn nghiên cứu – tỉnh Thừa Thiên Huế.

On the other hand, through the practices of research, the author has analyzed, pointing out the inadequacies, and the cause of implementation practices law in Thua Thien Hue province. Within theses his master, the author has attempted to study, build theories about the role and characteristics of the land, the characteristics of land legal relations is closely related to land leasing activities, reasoning about land lease legislation, overall assessment of the implementation of the law in Vietnam and studied in depth the legal situation of land lease in Thua Thien Hue province from which offer solutions to help perfect the land lease legislation and measures to ensure implementation of the law for land lease, from studies that do provide some general conclusions as follows:
Firstly, the author interpreted some reasonable issues comment on land, legal relations on land lease as concepts, characteristics and roles; construction and interpretation of the theoretical issues of land lease law include: Bases and conditions, competence, order and procedures for land rental unit. At the same time, give some solutions to improve the efficiency of implementation of Thua Thien Hue province to ensure that the provisions of the law on land lease is done effectively.
