5.4. Toàn bộ giá trị bảo lãnh thực

5.4. Toàn bộ giá trị bảo lãnh thực hiện hợp đồng sẽ được Ngân hàng bảo lãnh chuyển cho CĐT trong các trường hợp sau:
• Nhà tư vấn không thực hiện hợp đồng, đơn phương chấm dứt hợp đồng trái pháp luật hoặc không gia hạn giá trị Bảo lãnh thực hiện Hợp đồng trong thời hạn hai bên thỏa thuận.
• Nhà tư vấn không thanh toán cho CĐT các khoản nợ phát sinh phải trả theo quy định của Hợp đồng.
• Nhà tư vấn không sửa chữa các sai sót theo yêu cầu của CĐT theo quy định tại Hợp đồng và các phụ lục hợp đồng.
• Những tình huống cho phép CĐT được chấm dứt Hợp đồng theo quy định tại khoản 12.5 Điều 12 của Hợp đồng

5.4. The entire value of the contract performance guarantee Bank Guarantee will be transferred to Investor in the following cases:
• The consultant does not perform the contract, unilateral termination of the contract is unlawful or not renewed value The contract performance guarantee within the two parties.
• The consultant does not pay for debts incurred Investor payable under the provisions of the contract.
• The consultant does not fix the error on demand of Investor as defined in the contract and the contract appendix.
• The situation allows Investor may terminate the Contract in accordance with Clause 12.5 of Article 12 of the Agreement
