2. Một số chức năng và thẩm quyền giám sát của NHNN đối với các NHTM tại Việt Nam:
- Giám sát việc chấp hành pháp luật về tiền tệ và ngân hàng, quy định khác của pháp luật có liên quan, việc thực hiện các quy định trong giấy phép do Ngân hàng Nhà nước cấp;
- Xem xét, đánh giá hoạt động của ngân hàng, bao gồm cả hoạt động trong nước và ngoài nước, hoạt động của các công ty con, công ty liên kết, đơn vị trực thuộc của ngân hàng;
- Xem xét, đánh giá chất lượng và hiệu quả hệ thống quản trị, điều hành, hệ thống kiểm toán, kiểm soát nội bộ, hệ thống quản trị rủi ro, tình hình tài chính ngân hàng; các rủi ro tiềm ẩn, của ngân hàng.
- Yêu cầu ngân hàng và công ty con, công ty liên kết, đơn vị trực thuộc của ngân hàng và các tổ chức, cá nhân có liên quan báo cáo, cung cấp định kỳ hoặc đột xuất các thông tin, tài liệu theo yêu cầu.
- Khi xét thấy cần thiết, yêu cầu ngân hàng phải thực hiện kiểm toán độc lập để kiểm toán một, một số hoặc tất cả các nội dung trong hoạt động ngân hàng.
- Xử lý vi phạm hoặc kiến nghị các cơ quan nhà nước có thẩm quyền liên quan áp dụng các biện pháp phòng ngừa, ngăn chặn khi ngân hàng có các hành vi vi phạm pháp luật, nghiệp vụ có nguy cơ gây mất an toàn hoặc tổn thất cho ngân hàng.
- Tiến hành thanh tra, kiểm tra ngân hàng định kỳ hoặc đột xuất khi cần thiết.
