Detailed guidance on labor contracting and wage
Date 11.16.2015 Ministry of Labour, Invalids and Social Affairs issued Circular No. 47/2015 / TT-MOLISA (Circular 47) guiding a number of articles about labor contracts, labor discipline, material responsibility of Decree No. 05/2015 / ND-CP of the Government dated 12/1/2015 detailing and guiding the implementation of a number of text of the Labour Code. With some notable new features follows:

Accordingly, the Circular can explain and distinguish the concept of "salary and allowances and other additional terms," stated in the labor contract. Specifically as follows:
- "Salary" means basic salary determined by the salary scale
- "Earnings wage" is understood to include: the allowances to offset factors working conditions, compute the complexity of work, living conditions, the level of labor attracted by the salary levels in the labor contract or calculated excluding incomplete and allowances associated with the work process, work performance
- "Other Amendment" is understood to include the additional amounts paid associated with the work, the work performance of employees
, however, against the regime and other benefits, such as cash rewards, bonuses initiatives; meals between shifts; gasoline subsidies, telephone, transportation, housing, child care, raising children; support when employees have relatives died, workers have relatives marriage, birthday of workers, benefits for employees experiencing difficulties when labor accidents and occupational diseases and grants, allowances must be recorded as a separate item in the Labour Contract
Circular takes effect from the date of 01.01.2016 and replaces Circular No. 19/2003 / TT-MOLISA dated 22/9/2003 .
