Theo như Hợp đồng mua bán căn căn hộ, số 010130 được ký kết ngày 29/09/2015 , tại Điều 4 có nêu rõ: Trách nhiệm nộp thuế, lệ phí thì bên mua sẽ chịu trách nhiệm nộp thuế thu nhập cá nhân và lệ phí trước bạ.
Theo Điều 405 Bộ luật dân sự Việt Nam, do đó Hợp đồng mua bán căn hộ số 010130 sẽ được áp dụng thay cho Hợp đồng đặt cọc mà 2 bên đã ký kết trước đó.
Trên nguyên tắc, bên Bán sẽ chịu trách nhiệm kê khai và trả thuế thu nhập cá nhân, bên mua chịu trách nhiệm kê khai và trả thuế trước bạ.

According to the sales contract apartment, number 010 130 was signed on 09.29.2015, at Article 4 states: Liability to pay taxes, fees, the buyer will be responsible for paying taxes and personal income registration fee.
Under Article 405 of the Civil Code of Vietnam, therefore Purchase Agreement apartment number 010 130 will be applicable instead of the deposit contract that two sides signed earlier.
In principle, the Seller will be responsible for declaration and payment of personal income tax, the buyer is responsible to declare and pay registration tax.
