Do muốn tăng thêm sức thuyết phục và sự tin cậy của Thư của bố cháu Trang, tôi đã đề nghị bố cháu Trang viết Thư đồng ý cho cháu Trang theo mẹ sang Anh sinh sống và học tập trước sự chứng kiến của Cơ quan công chứng nhà nước tại Hải Phòng (Thư của bố kèm theo) (12) và tôi xin visa lần thứ 2 cho con gái vào tháng 01/2016. Tuy nhiên, lần xin visa thứ 2 này cũng không thành công với lý do tương tự như lần 1 rằng tôi vẫn chưa cung cấp đủ bằng chứng về việc có toàn quyền bảo trợ, giám sát đối với con gái tôi (Thư của ĐSQ kèm theo) (13).

Do thời hạn visa của tôi hết hạn vào 31/01/2016 và do khóa học của tôi bắt đầu vào tháng 01/2/2016, tôi không có sự lựa chọn nào khác là sang Anh theo học và gửi lại cháu Trang cho mẹ tôi chăm sóc, nuôi dạy và nhờ chị gái tôi thay tôi theo dõi và liên lạc với cô giáo của cháu về việc học tập của cháu tại trường từ tháng 02/2016 cho đến nay (Thư của bà ngoại, thư của bác Hạnh, Thư của cô giáo chủ nhiệm lớp 6.7 kèm theo) (14).

Suốt thời gian qua, tôi đã tìm hiểu kỹ hơn về việc ‘‘toàn quyền bảo trợ’’ đối với con cái trong trường hợp của tôi và tôi nhận thấy rằng tôi đã & đang thực hiện ‘‘toàn quyền bảo trợ’’ đối với con mình với những lý do sau đây:

Thứ nhất, tôi và đối tác của tôi đã chia tay nhau từ tháng 8/2013 cho tới nay (Thư của bố Trang kèm theo) (15).

Thứ hai, từ thời điểm chia tay 2013 cho tới nay, con gái tôi & tôi chuyển từ thành phố Hải Phòng về sinh sống tại nhà mẹ đẻ tôi tại thành phố Hà Nội (Thư của hàng xóm, thư của chính quyền địa phương (16); con gái tôi chuyển trường học từ thành phố Hải Phòng tới thành phố Hà Nội vào năm học lớp 5 và tiếp tục học lớp 6, lớp 7 tại thành phố Hà Nội (có học bạ kèm theo, có Xác nhận của trường) (17).

Thứ ba, từ năm học lớp 5, 6, 7 và cho tới nay, mọi việc liên quan đến nuôi nấng, chăm sóc cháu, việc học tập của cháu như đóng học phí, học ngoại khóa (học đàn, học tiếng Anh), đưa đón cháu đi học, đi dã ngoại với bạn bè, v.v… đều do một mình tôi chi trả và quyết định hoàn toàn (Thư của cô giáo lớp 5, lớp 6 & 7, hóa đơn tiền học, Thư của cô giáo lớp đàn, Thư của cô giáo lớp tiếng Anh) (18).

Thứ tư, thời gian từ lúc cháu Trang sinh ra cho đến trước khi chúng tôi chung sống cùng nhau (2003 - 2010), toàn bộ việc nuôi nâng, chăm sóc, dạy dỗ, vui chơi, cũng như đi học trường mầm non của cháu đều do tôi quyết định và chi trả, bố cháu không có bất cứ trách nhiệm gì (Thư của bố Trang kèm theo, Xác nhận của chính quyền địa phương) (19).

Thứ năm, kể từ khi tôi sang Anh học tập (tháng 01/2016 cho đến nay), tôi đã xa cách con gái tôi hơn 6 tháng. Trong suốt hơn 6 tháng qua, tôi gửi lại con gái tôi cho mẹ đẻ của tôi chăm sóc, nuôi dạy và nhờ chị gái tôi thay mặt tôi liên lạc với cô giáo về việc học tập và sinh hoạt của cháu ở trường. Mọi chi phí sinh hoạt và học tập của con gái tôi vẫn do một mình tôi chi trả toàn bộ. Và tôi vẫn thường xuyên gọi điện về nhà dặn bà, bác cháu chăm sóc và theo dõi việc học tập của cháu (Thư của bà ngoại, của bác Hạnh) (20).

Thứ sáu, do mẹ đẻ tôi năm nay đã ngoài 70 tuổi, lại bị bệnh tật, sức khỏe yếu kém; chị gái tôi lại bận bịu việc nuôi con nhỏ, nên tôi rất mong muốn được đưa cháu Trang theo tôi sang Anh để tôi trực tiếp nuôi dạy và chăm sóc cháu (Giấy khám sức khỏe của bà ngoại) (21).

Để chuẩn bị nơi ở cho cháu tại Anh, tôi đã ký Hợp đồng thuê nhà (Hợp đồng thuê nhà …..). Nhà tôi thuê có 3 phòng ngủ, 1 phòng ngủ đôi to, 1 phòng đôi và 1 phòng đơn. Hợp đồng thuê nhà gồm có 3 người: Đào Thị Hảo, Trịnh Công Luận, Nguyễn Diễm, trong đó 2 người Trịnh Công Luận và Nguyễn Diễm là 1 cặp vợ chồng và họ sống ở phòng ngủ đôi to, tôi ở 1 phòng đôi và còn 1 phòng đơn - dự định dành cho cháu Trang ở khi sang Anh cùng tôi (Hợp đồng thuê nhà, Giấy Đăng ký kết hôn của Luận - Diễm) (22).

Về việc học cho cháu, tôi dự định cho cháu học ở 1 trường công lập tại Newcastle. Tôi đã tìm hiểu các trường trung học cơ sở tại Newcastle, đọc báo cáo đánh giá của các trường (ofsted), tìm hiểu các phương tiện đến trường, thời gian đi đến trường và tôi đã đến Council để hỏi thủ tục nhập học cho cháu. Council có trả lời rằng họ chỉ xem xét việc nhận học cho cháu khi cháu có đủ bằng chứng chứng tỏ đã có mặt tại Newcastle (Booklet của Council và ticket về việc đến Council) (23).

Với những lý do trên, tôi đã trở về Hà Nội, viết đơn này, xin giải trình rõ hơn hoàn cảnh của tôi. Tôi tin rằng tôi đã và đang đáp ứng đầy đủ các yêu cầu của Điều khoản 319H (F) trong Luật Nhập cư của Anh về việc thực hiện quyền bảo trợ duy nhất đối với con gái Vũ Minh Trang. Tôi kính mong Tổng lãnh sự quán Anh tại Bankok xem xét cấp visa cho con gái tôi.
