Điều 72 Luật SHTT Việt Nam về điều kiện bảo hộ nhãn hiệu quy định dấu hiệu bảo hộ là nhãn hiệu bao gồm “chữ cái, từ ngữ, hình ảnh, kể cả hình ba chiều hoặc sự kết hợp các yếu tố đó”. Với quy định này, pháp luật SHTT Việt Nam đã chính thức thừa nhận việc bảo hộ nhãn hiệu đối với dấu hiệu “hình ba chiều” hay còn được gọi là nhãn hiệu 3D.
Mặc dù có sự sửa đổi như vậy, nhưng cho đến nay, pháp luật SHTT Việt Nam vẫn thiếu vắng những quy định hướng dẫn cụ thể về điều kiện bảo hộ nhãn hiệu dạng hình ba chiều cũng như những thủ tục để có thể đăng ký loại nhãn hiệu này. Điều này đã gây ra những khó khăn, vướng mắc cho các cơ quan có thẩm quyền trong các vụ việc liên quan đến đăng ký và thực thi quyền SHTT đối với nhãn hiệu dạng hình ba chiều, cũng như khiến cho các doanh nghiệp băn khoăn khi họ muốn đăng ký hình dạng hay hình khối của sản phẩm như một nhãn hiệu.

Article 72 Vietnam IP Law on conditions of protection of the trademark regulations signs protected as trademarks include "letters, words, pictures, including three-dimensional shape or combination of factors". With this legislation, rules Vietnam has officially acknowledged the trademark protection for the mark "hologram", also known as 3D trademarks. Despite such modifications, but so far, legislation Vietnam still lack specific guidelines rules of eligibility for protection of the trademark three-dimensional shapes as well as the procedure to be able to register the type label. This has caused difficulties and problems for the competent authorities in the cases related to the registration and enforcement of IPR for three-dimensional shape marks, as well as making businesses fret when they want to register the shape or shapes of the products as a brand.

Vietnam IP Law Article 72 on protection conditions prescribed brand protection signs are trademarks including "letters, words, photos, including hologram or a combination of those factors." With this regulation, IPR legislation Vietnam has officially recognized the trademark protection for signs of "hologram" or also known as 3D marks.

This has caused difficulties and problems faced by the competent authorities in cases involving the registration and enforcement of IP rights for the trademark three-dimensional shape, as well as making businesses fret when they want to register the shape or shapes of the product as a brand.
