Mới chỉ hơn 01 năm kể từ ngày Luật Đất đai 2013, Luật Nhà ở 2014, Luật Kinh doanh Bất động sản 2014 và Luật Đầu tư 2014 có hiệu lực, thực tiễn thi hành đã chỉ ra một số bất cập liên quan đến việc sở hữu nhà ở của tổ chức, cá nhân nước ngoài tại Việt Nam, tạo ra sự khó khăn trong quá trình áp dụng pháp luật, ảnh hưởng đến tâm lý đầu tư của các nhà đầu tư nước ngoài vào Việt Nam. Qua bài viết này, chúng tôi hy vọng sẽ truyền tải được những bất cập của pháp luật liên quan đến việc sở hữu nhà ở của tổ chức, cá nhân nước ngoài đến các nhà lập pháp, để công tác xây dựng pháp luật về nhà ở được hoàn thiện hơn trong thời gian tới.

Just over 01 years after the date of the Land Act 2013, the Housing Act 2014, the Real Estate Business Law and the Investment Law 2014 2014 effective, practical implementation has shown a number of shortcomings relating to the establishment ownership housing organizations and foreign individuals in Vietnam, creating difficulties in the application of law, affect the investment sentiment of foreign investors in Vietnam. Through this article, we hope to convey the inadequacy of the law relating to the ownership of housing organizations and foreign individuals to lawmakers, to the formulation of legislation be improved in the future.
