Nhà tư vấn phải nộp bảo lãnh thực hiện Hợp đồng và Bảo lãnh tạm ứng bằng chứng thư được phát hành bởi Ngân hàng TMCP Công thương Việt Nam (do đơn vị có địa điểm hoạt động tại TPHCM phát hành) và phải theo mẫu được Chủ đầu tư chấp thuận. Chi phí để nhận được Bảo lãnh này sẽ do Nhà Tư vấn chi trả và CĐT sẽ không thực hiện bất kỳ điều khoản thanh toán nào khi chưa nhận được đầy đủ Chứng thư bảo lãnh hợp lệ từ Nhà tư vấn.
5.1. Giá trị bảo lãnh
5.2.1 Giá trị bảo lãnh thực hiện hợp đồng: tương đương 10% giá trị hợp đồng.
5.2.2 Giá trị bảo lãnh tạm ứng: tương đương giá trị khoản tiền tạm ứng trước khi chủ đầu tư thực hiện việc tạm ứng.
5.2. Thời hạn hiệu lực của Chứng thư bảo lãnh: cho đến khi các bên hoàn thành toàn bộ việc nghiệm thu, thanh quyết toán giá trị hợp đồng cộng thêm 30 ngày.
Nếu các điều khoản của Chứng thư bảo lãnh nêu rõ ngày hết hạn và Nhà tư vấn chưa hoàn thành các nghĩa vụ của hợp đồng vào thời điểm 07 ngày trước ngày hết hạn, Nhà tư vấn sẽ phải gia hạn giá trị bảo lãnh thực hiện hợp đồng và bảo lãnh tạm ứng cho tới khi công việc đã được hoàn thành và mọi sai sót đã được sửa chữa xong và việc gia hạn phải hoàn tất vào thời điểm 03 ngày trước ngày hết hạn.
5.3. Toàn bộ giá trị bảo lãnh thực hiện hợp đồng sẽ được Ngân hàng bảo lãnh chuyển cho CĐT trong các trường hợp sau:
i. Nhà tư vấn không thực hiện hợp đồng, đơn phương chấm dứt hợp đồng trái pháp luật hoặc không gia hạn giá trị Bảo lãnh thực hiện Hợp đồng trong thời hạn hai bên thỏa thuận.
ii. Nhà tư vấn không thanh toán cho CĐT các khoản nợ phát sinh phải trả theo quy định của Hợp đồng.
iii. Nhà tư vấn không sửa chữa các sai sót theo yêu cầu của CĐT theo quy định tại Hợp đồng và các phụ lục hợp đồng.
iv. Những tình huống cho phép CĐT được chấm dứt Hợp đồng theo quy định tại khoản 12.5 Điều 12 của Hợp đồng.
5.4. Toàn bộ giá trị bảo lãnh tạm ứng sẽ được Ngân hàng chuyển cho CĐT trong các trường hợp sau:
v. Quá thời hạn quy định mà Nhà tư vấn vẫn chưa gia hạn Chứng thư bảo lãnh tạm ứng.
vi. Đến thời điểm phải thu hồi tiền tạm ứng theo quy định của Hợp đồng hoặc tại thời điểm Hợp đồng chấm dứt trước thời hạn bằng bất kỳ lý do gì mà CĐT vẫn chưa thu hồi hết tiền tạm ứng theo quy định của Hợp đồng;

II. non-consultant payments to INVESTORS debts incurred to pay in accordance with the contract.III. A consultant does not fix the errors at the request of INVESTORS as defined in the contract and the annex.IV. Situations that allow INVESTORS to be termination of the contract as specified in clause 12.5 article 12 of the agreement. 5.4. The entire advance guarantee value will be transferred to the Bank INVESTORS in the following cases: v. The timelines stipulated that a consultant has yet to renew the certificate of guarantee to advance.vi. To the time to recover the money deposited under the provisions of the contract or at the time of contract termination ahead of time with any reason that INVESTORS have yet to recover all advances under the provisions of the contract;

Results (English) 2:

The consultant must submit contract performance guarantees and advance payment guarantee by deed issued by the Bank for Industry and Trade of Vietnam (by units operating locations in HCMC release) and to form the owners Investment approval. The cost to get this guarantee paid by the Consultant and Investor will not make any payments until you have received adequate guarantees valid certificate from consultants.
5.1. Value Guarantee
5.2.1 Value guarantee of contract performance: equivalent to 10% of the contract value.
5.2.2 Value advance guarantee: equivalent value of cash advances before performing investor the advance.
5.2. The effective duration of the Deed of Guarantee: until the parties have completed the entire acceptance and settlement of the contract value plus 30 days.
If the terms of the Deed of Guarantee stated expiration date and unfinished consultant contractual obligations at the time of 07 days before the due date, the consultant will take the extension of the guarantee contract performance guarantees and advance payment until the work has been completed Members and any errors have been corrected and the extension must be completed by the time 03 days before the expiry date.
5.3. The entire value of the contract performance guarantee Bank Guarantee will be transferred to Investor in the following cases:

5.4. Complete advance guarantee value will be transferred to the Investor Bank in the following cases:
v. Exceed the time limit specified by consultants has not yet extended the advance guarantee certificate.
vi. By the time of the advance to be recovered under the provisions of the Contract or at the time the contract is terminated prior to the time limit by any reason that has not yet fully recovered Investor advance under the provisions of the contract;
