Theo dự thảo nghị định sửa đổi, bổ sung một số điều của Nghị định 83 về kinh doanh xăng dầu do Bộ Công thương soạn thảo, có nội dung cho thương nhân kinh doanh xăng dầu được chuyển nhượng cổ phần cho nhà đầu tư nước ngoài không qua 34%. Hiện tại các nhà đầu tư nước ngoài đã tham gia vào thị trường lọc dầu bằng hình thức liên doanh. Thực tế, Việt Nam không cam kết mở cửa thị trường xăng dầu trong các hiệp định thương mại tự do, trừ các DN đầu tư vào nhà máy lọc dầu tại Việt Nam để phân phối sản phẩm mình làm ra. Khi chế biến được rồi, nhà đầu tư có quyền mở tiếp các cửa hàng bán lẻ để phân phối xăng dầu đã được sản xuất. Tuy nhiên, các điểm bán lẻ xăng dầu được quản lý bởi mỗi địa phương và án ngữ bởi DN phân phối xăng dầu trong nước.

According to the draft decree amending and supplementing some articles of Decree 83 on petrol by the Ministry of Industry and Trade drafted content for traders of petroleum traded shares to foreign investors not over 34%. Currently, foreign investors have been engaged in oil refining market in the form of joint ventures. Indeed, Vietnam is not committed to opening markets in the petroleum free trade agreements, except for enterprises to invest in refinery in Vietnam to distribute their products made.
