Do vậy đàm phán thương mại song phương Hoa Kỳ – Việt Nam, một mặt có cùng bản chất với WTO là trao đổi về các sự nhượng bộ mở cửa thị trường trên cơ sở có đi có lại, nên đàm phán thương mại này có tác dụng hỗ trợ lẫn nhau trên cùng một nền tảng là Việt Nam cải cách chế độ thương mại của mình để tăng khối lượng thương mại của mình và hiệu qủa nền kinh tế. Mặt khác, theo luật Hoa Kỳ và trên thực tế một quốc gia có thể được nhận là thành viên của WTO nhưng điều này không ảnh hưởng gì đến quan hệ thương mại với Hoa Kỳ (chẳng hạn vẫn không được hưởng quy chế MFN và GSP của Hoa Kỳ hoặc các ưu đãi khác thì đàm phán song phương Việt Nam - Hoa Kỳ có tính độc lập và then chốt với việc gia nhập WTO). Theo thực tế đàm phán thương mại của nhiều nước đang phát triển nhất là của các nước Đông Âu cũ và gần đây nhất là Mông Cổ với Hoa Kỳ thì cản trở mà Việt Nam phải đương đầu là luật Jackson - Vanik, luật chống bán phá giá và thuế đối kháng của Hoa Kỳ (AD&CVD law). Trừ luật Jackson- Vanik liên quan đến chính trị, thì luật AD&CVD liên quan đến cơ chế quản lý giá cả và sự can thiệp của Nhà nước vào công nghiệp và các doanh nghiệp nhà nước. Do vậy việc xem xét lại chính sách công nghiệp và cải cách là rất quan trọng trên phương diện hoạch định chính sách không chỉ do sức ép từ bên ngoài mà chủ yếu là từ nhu cầu nội bộ của nền kinh tế.
Chúng ta có thể hiểu thêm về chính sách thương mại quốc tế của Hoa Kỳ (và cũng là vai trò của Hoa Kỳ) trên thị trường thế giới và trong WTO thông qua những điểm sau:
- Hiện nay Hoa Kỳ là nước duy nhất áp dụng những biện pháp vượt quá biên giới quốc gia (extraterriatily) nhằm trừng phạt những công ty nước ngoài làm ăn với Cuba, Iran và Libya, để điều chỉnh cả các quan hệ thương mại của nhiều nước lớn khác. Mặt khác cơ chế giải quyết tranh chấp trong WTO trong nhiều trường hợp Hoa Kỳ vượt qua do chủ nghĩa đơn phương (Unilateralism) trong hệ thống pháp luật. ở đây Hoa Kỳ vẫn tiếp tục duy trì khả năng tiến hành các biện pháp đơn phương không phù hơợ với các nguyên tắc đã được thoả thuận trong WTO. Các hành động đơn phương được tiến hành bởi một số nước không phải là điều lạ, nhưng với Hoa Kỳ điều này là sự cố gắng thay đổi chính sách thương mại của các nước bạn hàng của Hoa Kỳ. Đây thực sự là điều rất quan trọng trong quan hệ thương mại Việt Nam - Hoa Kỳ.
- Các hàng rào phi quan thuế được tăng cường sử dụng hết sức tinh vi và phức tạp thể hiện trong tất cả các lĩnh vực như thủ tục hải quan, quy định kỹ thuật, mua sắm của Chính phủ, công nghiệp hàng không và vận tải biển, an ninh quốc gia, đối xử quốc gia, sở hữu trí tuệ và các dịch vụ chuyên gia.
- Các thoả thuận song phương với các nước và vùng lãnh thổ có ý nghĩa rất quan trọng với Hoa Kỳ và thị trường thế giới. Hoa Kỳ đã ký với EU là bạn hàng lớn nhất của Hoa Kỳ và việc tạo lập thị trường xuyên Đại Tây Dương mới, khu mậu dịch tự do Bắc Mỹ (NAFTA) cũng có tầm quan trọng không kém. Hiện nay khu vực Châu á Thái Bình Dương với APEC đã trở nên có tầm quan trọng chiến lược với Hoa Kỳ trong thế kỷ XXI. Tất cả những điều này phải tính đến trong đàm phán song phương cũng như đa phương của Việt Nam với Hoa Kỳ. Vì đơn giản là Việt Nam với quá trình chuyển sang thị trường và hội nhập nền kinh tế thế giới đã tự nhiên trở thành bộ phận hữu cơ của bàn cờ chiến lược quốc tế.
