Đương sự hai bên xác nhận những dữ liệu liên quan đến khách hàng và các thiết kế sản phẩm, quy cách, dữ liệu giá thành, tiêu thụ, phần mềm xử lý, chế tạo, phân phối, phương thức kinh doanh và hệ thống hoạt động, các thông tin kỹ thuật và kinh doanh. Bên thứ ba khác cung cấp thông tin kinh doanh và kế hoạch cho người đương sự nào thì bên còn lại phải đảm bảo tính bảo mật thông tin và bản thân của đương sự hai bên với cán bộ nhân viên hoặc người đại diện phải đồng ý những điều như sau:
